AK "Stevanović" continues the fight for the status of "Parent Caregiver."

As part of the representation and protection of the rights of mothers and children with developmental disabilities, whose rights were endangered by the revocation of their "parent-caregiver" status, AK "Stevanović" took legal action. Within the administrative procedure conducted before the competent fund, this right was denied, based on specific regulations that allowed parents and children to lose this status if the child showed improvement in their health, psychological, or mental condition. As a result, the right was taken away, and appeals to the competent fund were not accepted.

AK "Stevanović" represented the mothers of children with disabilities in seeking court rulings that would affirm their rights, ensuring the continuation of benefits, including monthly allowances and other entitlements. Lawyer Jevto Kalajdžić from AK "Stevanović" explained this legal battle, emphasizing the importance of securing these rights through judicial decisions.

Currently, two legal disputes have been concluded successfully, with the District Court in Bijeljina issuing two rulings that annul the contested decisions and uphold the plaintiffs' claims.

Through this legal process, one of the key demands is the abolition of the age limit of 30 years for children/adults with developmental disabilities, allowing them to continue receiving certain benefits even after this age. Additionally, it seeks to extend the "parent-caregiver" status beyond the age of 65. The proposal includes defining half-day care (4 to 6 hours) and full-day care (6 to 10 hours) and ensuring that parents receiving caregiver benefits also have their contributions and taxes covered. Furthermore, parents should receive financial support for six months following the death of their child.

Another crucial demand is the removal of the "Barthel test," which has proven to be an inadequate tool for assessing children’s conditions, often creating a misleading picture based on past experiences. Additionally, palliative care should be equated with full-time care to ensure appropriate support.

AK "Stevanović" provides free legal representation to parents of children with developmental disabilities in such cases before the competent authorities, driven by emotional, social, and professional reasons.
